Wedding Photography Contract

This agreement is made on [DATE] between 4OnceInYourLife (hereafter referred to as “Photographer”) and [CLIENT NAME] (hereafter referred to as “Client”).

1. PAYMENT AND PRICE
Client agrees to pay [PRICE] for wedding photography services, which includes photography on the wedding day and photo editing. A deposit of €100 is required to secure the date, with the remaining balance due 5 days prior to the wedding day. In the event that the client fails to pay the remaining balance by the due date, the photographer reserves the right to cancel the photography session and retain the deposit.

2. COOPERATION OF CLIENT
Client agrees to provide full cooperation throughout the photography process, including providing a list of desired shots, designating 3 persons to assist with the photography, and adhering to the agreed-upon schedule. For full day weddings, client agrees to provide a simple meal for the photographer and videographer, such as a meal typically provided to musicians or waitstaff. The photographer is not responsible for missed shots or subpar quality of photographs resulting from the client’s failure to cooperate. In the event that inclement weather or other unforeseen circumstances disrupt the photography schedule, the photographer will make reasonable efforts to find an alternative location for the photography session that is acceptable to both parties.

3. COPYRIGHTS
The photographer retains the copyrights to all images captured during the photography session. Client agrees to not sell, modify, or distribute any images without the photographer’s written consent. The photographer reserves the right to use the images for promotional purposes, including on their website and social media pages.

4. LIMIT OF LIABILITY
The photographer is not responsible for any loss or damage to any property or for any personal injury incurred during the photography session. The client agrees to release the photographer from any liability for any such loss, damage, or injury. In the event that the photographer is unable to provide the agreed-upon services due to illness, emergency, or other unforeseen circumstances, the photographer will make reasonable efforts to provide a replacement photographer of equal or greater quality. If a replacement photographer is not available, the photographer’s liability is limited to a refund of all payments received.

5. CANCELLATION AND REFUND POLICY
In the event that the client cancels the photography session, the deposit is non-refundable. If the cancellation is made 14 days or less before the wedding day, the full price is still due. If the photographer cancels the session for any reason, the deposit and any other payments made by the client will be refunded in full.
6. IMAGE DELIVERY
The photographer will provide the client with a Dropbox link of high-resolution, edited images within 14 days of the photography session. The client is responsible for downloading and backing up the images. The photographer is not responsible for any loss or damage to the images after they have been delivered. The format is JPG (SRGB)

7. VIDEO DELIVERY
Video will be delivered in Full HD resolution. (1,920 x 1,080 pixels) If another resolution wanted, this need to be agreed in advance. There will be provided a YouTube link, and a movie file.

8. RAW files
The Photographer retains all rights to the RAW (Digital negative) files captured during the wedding photography and videography sessions. The Client acknowledges that RAW files are the proprietary and unprocessed data of the Photographer and are not available for purchase or distribution.

The final edited images and videos delivered to the Client represent the culmination of the Photographer’s artistic vision and post-processing expertise. The editing process is an essential part of the Photographer’s style and the final product delivered to the Client.

The Client agrees not to request or demand access to the RAW files under any circumstances, as the Photographer does not release RAW files for distribution. The Photographer ensures that the final edited images and videos provided to the Client meet the highest standards of quality and artistic integrity.

9. ADDITIONAL SERVICES
Additional services beyond the wedding day photography, such as album creation etc, is available at an additional cost. These services can be discussed and agreed upon between the client and photographer.

10. CLIENT RESPONSIBILITY
The client is responsible for obtaining any necessary permits or permissions for photography at the wedding venue, and for informing the photographer of any restrictions or guidelines set by the venue.

11. PHOTOGRAPHY STYLE AND EDITING
The client acknowledges that the photographer’s style of photography and editing is subject to artistic interpretation and that the final product may not be identical to samples or examples provided. The client also agrees to not request any specific editing techniques that are not part of the photographer’s normal editing process.
The images are not “Photoshopped”, so for example the jacket is straightened, the dress is straightened, posture is changed, hair is changed, skin is smoothed, removal of birthmarks etc.
We make a point of correcting these things before the picture is taken.

12. PHOTOGRAPHER’S ATTIRE
The photographer will dress appropriately for the wedding and will make every effort to blend in with the wedding party and guests.

13. IMAGE RETENTION
The photographer will retain the images captured during the photography session for a period of 1 YEARS. After this time, the photographer may delete the images without notice.

14. MODEL RELEASE
The client grants the photographer the irrevocable and unrestricted right to use and publish photographs of the client and/or guests for editorial, trade, advertising, or any other purpose and in any manner and medium. The client releases all claims for any compensation in connection with the use of these photographs.

15. TIME OVERRUNS
If the photography session exceeds the agreed-upon time, the photographer may charge an additional fee at their hourly rate. This fee will be discussed and agreed upon before the photography session.
16. LIMITATIONS OF COVERAGE
The photographer is not responsible for photographing events or activities that are missed due to the client’s or guests’ actions or availability. The photographer is also not responsible for photographing events or activities that are not part of the agreed-upon schedule.

17. TRAVEL AND ACCOMMODATION
If the wedding location is outside of the photographer’s local area, the client is responsible for providing travel and accommodation for the photographer and any assistants.

18. FORCE MAJEURE
The photographer is not liable for any failure or delay in the performance of their obligations under this agreement due to any cause beyond their control, including acts of God, acts of government, natural disasters, or other emergencies.

19. SEVERABILITY
If any provision of this agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

20. AMENDMENTS
This agreement may only be amended in writing and signed by both the client and the photographer.

21. WAIVER
The failure of either party to enforce any provision of this agreement shall not be deemed a waiver of such provision or any other provision of this agreement.

22. NOTICES
All notices and other communications required or permitted under this agreement shall be in writing and sent to the parties’ addresses listed on this agreement, or to such other address as either party may designate in writing.

23. HEADINGS
The headings in this agreement are for convenience only and shall not be used to interpret or construe any provision of this agreement.

24. SURVIVAL
Any provisions of this agreement that by their nature should survive termination of this agreement shall survive, including, but not limited to, the copyright provisions and the limitations of liability provisions.

25. SIGNATURES
By signing below, the client acknowledges that they have read and understood the terms of this agreement and agree to be bound by them.
